Terms of Service

1. Acceptance of Terms
By accessing or using Pactiamo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.
2. Description of Service
Pactiamo is a SaaS platform that enables freelancers, independent developers, and small teams to create, share, and execute professional proposals and contracts online, including electronic signatures and integrated payment collection.
3. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at support@pactiamo.com.
4. Subscription and Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed by our authorized payment processor, acting as Merchant of Record. By subscribing, you agree to their terms in addition to ours. Prices are displayed inclusive of applicable taxes where required by law.
5. Refund Policy
All subscription purchases are final and non-refundable. We recommend using our free plan to evaluate the Service before subscribing. If you believe a charge was made in error or without authorization, please contact us at support@pactiamo.com within 30 days of the charge and we will investigate.
6. Acceptable Use
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe the intellectual property rights of others; (c) upload or transmit malicious code; (d) engage in unauthorized access to any system; (e) use the Service for spam or unsolicited commercial communication; or (f) reverse-engineer or attempt to extract the source code of the Service.
7. Intellectual Property
Pactiamo and its licensors own all intellectual property rights in the Service. You retain ownership of the content you create using the Service. By using the Service, you grant Pactiamo a limited, non-exclusive license to store and process your content solely to provide the Service to you.
8. Termination
You may terminate your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms, with or without prior notice. Upon termination, your right to access the Service ceases immediately. Content deletion follows our data retention policy described in the Privacy Policy.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Pactiamo does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not a law firm and do not provide legal advice; documents generated by the Service do not constitute legal advice.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Pactiamo's total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amounts you paid to Pactiamo in the twelve (12) months preceding the claim. Pactiamo shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Pactiamo operates, without regard to its conflict-of-law provisions. Any disputes shall be resolved exclusively through binding arbitration or in the courts of the applicable jurisdiction.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
